A BILL to amend and reenact section fourteen, article two,
chapter seventeen-b of the code of West Virginia, one
thousand nine hundred thirty-one, as amended, relating to
the division of motor vehicles keeping records of license
suspensions and revocations for two years only.
Be it enacted by the Legislature of West Virginia:
That section fourteen, article two, chapter seventeen-b of
the code of West Virginia, one thousand nine hundred thirty-one,
as amended, be amended and reenacted to read as follows:
ARTICLE 2. ISSUANCE OF LICENSE, EXPIRATION AND RENEWAL.
§17B-2-14. Records and indexes to be kept by the division.
The division shall file every application for a license
received by it and shall maintain suitable indexes containing,
in alphabetical order:
(1) All applications denied and on each a notation of the reasons for such denial;
(2) All applications granted; and
(3) The name of every licensee whose license has been
suspended or revoked by the division and after each such name a
notation of the reasons for such action.
The division shall also file all abstracts of court records
of convictions received by it under the laws of this state and in
connection therewith maintain convenient records or make suitable
notations in order that an individual record of each licensee
showing the convictions of such licensee shall be readily
ascertainable and available for the consideration of the division
upon any application for renewal of license and at other suitable
times.
Any record or index kept by the division pursuant to this
section shall be purged after two years.
NOTE: The purpose of this bill is to limit to two years the
time in which the department of motor vehicles keeps records of
license suspensions and revocations.
